In the indictment, doctor Hoang Cong Luong was charged with the crime of "lack of responsibility, causing serious consequences". Doctor Hoang Cong Luong felt sad and shocked because that responsibility did not belong to him, the serious consequences were caused by those responsible. According to Dr. Luong, before the date of dialysis for the patient, on May 28, 2017, the repair and maintenance of the RO water system was performed by Thien Son Pharmaceutical Joint Stock Company. The Hospital's Medical Equipment and Supplies Department has someone overseeing this process. Dr. Luong believes that work related to repair and maintenance of RO water systems is not related to his and his colleagues' expertise and responsibilities. Dr. Luong only uses RO water for hemodialysis after the handover record has been obtained.
On May 30, 2017, Hoa Binh Provincial Police initiated a case to investigate.
On June 22, 2017, the procedural agency prosecuted and detained 3 suspects, in which doctor Hoang Cong Luong was prosecuted for "violating regulations on medical treatment" (according to Article 242 Criminal Code 1999).
On July 5, 2017, the People's Procuracy of Hoa Binh province decided to change the preventive measures, allowing Dr. Hoang Cong Luong to be released on bail after 13 days. detained with a restraining order from leaving the residence.
November 14, 2017. The People's Procuracy of Hoa Binh province has decided to change the crime of doctor Hoang Cong Luong from "Crime of violating regulations on medical treatment" to "Crime of irresponsibility causing serious consequences".
With the hope that the dialysis case that caused 8 deaths in Hoa Binh to be tried publicly, with the right person, with the right crime, Doctor Hoang Cong Luong sent a letter to the General Secretary Nguyen Phu Trong, President Tran Dai Quang, Prime Minister Nguyen Xuan Phuc and Chairman National Assembly Chairwoman Nguyen Thi Kim Ngan.
After the case happened, Dr. Hoang Cong Luong received many leading experts from the Ministry of Health, the Vietnam Association for Emergency Resuscitation and Anti-Poisoning, the General Medical Association of Vietnam, the Vietnam Young Physicians Association. Nephrology and more than 10,000 colleagues and people signed their wish that the case would be tried in a fair and lawful manner.
On the afternoon of May 30, 2018, the trial of the medical accident on dialysis at Hoa Binh General Hospital ended the litigation after 12 working days. Before the trial panel deliberations, the defendants have the last word. Doctor Hoang Cong Luong said: "What the defendant and the medical staff of Hoa Binh Provincial General Hospital suffered the most was not being able to save all the patients at the time of the incident. The report sends its deep condolences to the families of the victims, and shares the pain with the families.". Doctor Hoang Cong Luong insists he is completely innocent. After deliberating for about 15 minutes, the presiding judge of the trial, Nghiem Hoai Anh, said that due to the complicated nature of the case, the Trial Panel decided to extend the deliberation time. 6/2018.
