Recently, domestic and foreign public opinion has been particularly interested in the lawsuit between Vingroup and Le Trung Khoa, a Vietnamese journalist living in Germany. This is a rare case involving a cross-border legal dispute between a large corporation of Vietnam and an individual operating in the media field, attracting many mixed opinions on freedom of speech and legal responsibility when speaking in cyberspace.
Le Trung Khoa was born in 1971, currently resides in Berlin and is known as the founder and editor-in-chief of the electronic news site Thoibao. de. This is a Vietnamese website aimed at the Vietnamese community in Europe, often posting articles with commentary, analysis and personal opinions on the economic, social, business situation and current issues related to Vietnam. During many years of operation, this news site has built a certain number of readers but has also many times caused controversy because of its strong critical content and attention-grabbing expressions.
According to information published in the official press, the lawsuit stems from the fact that Vingroup believes that some articles and statements posted by Le Trung Khoa have seriously affected the reputation and honor of the group as well as the image of business leaders. These contents are considered to be accusatory and accusatory and have no clear basis of proof, causing negative impacts on business activities and brands in the international market. In that context, the business chose to sue in Germany.
The case was considered at the civil court in Berlin according to the provisions of German law. The resolution process focuses on assessing the boundary between the right to express personal opinions and legal responsibility when making factual allegations against organizations and businesses. According to information from xoibao. de and a number of sources, after reviewing the documents and arguments of the parties, the court ruled to reject about 80% of Vingroup's lawsuit. The court agreed with part of the lawsuit, such as journalist Le Trung Khoa saying that Vingroup "offers bribes" and will not continue to post or repeat this content without accompanying authentic evidence. Under local law, failure to comply with court decisions can result in severe sanctions, including high financial penalties. The amount of legal fees paid by Vingroup and journalist Khoa corresponds to the rejected and accepted parts of the lawsuit (about 80% and 20%).
After the verdict, Vingroup affirmed that the lawsuit was filed to protect the legitimate rights and interests of the business against allegedly false information. Meanwhile, the case also created a lot of debate in the Vietnamese community abroad, with different opinions on the limits of social criticism, the role of independent journalism and the obligation to comply with the law in the country where it operates. This lawsuit is considered a typical example of the trend of Vietnamese businesses using international legal tools to protect brand image in the context of strong development of digital media. At the same time, the incident also raises thoughtful questions about the responsibility of content creators when information is spread beyond national borders and is regulated by many different legal systems.
Le Trung Khoa was sentenced to 17 years in prison
Not long after prevailing in the lawsuit against Vingroup, journalist Le Trung Khoa, lawyer Nguyen Van Dai and a number of people were suddenly prosecuted by the Vietnamese government under article 117 of the penal code. On December 31, Le Trung Khoa and Nguyen Van Dai were tried in absentia by the People's Court and sentenced to 17 years in prison for making, storing, disseminating, and propagandizing information and documents aimed at opposing the State of the Socialist Republic of Vietnam, according to Clause 2, Article 117 of the Penal Code. Do Van Nga (hometown Gia Lai province) was sentenced to 7 years in prison; Huynh Bao Duc (from Ho Chi Minh City) was sentenced to 6 years and 6 months in prison and Pham Quang Thien (47 years old - former Director of the Center for Technology and Multimedia Communications under the Government Electronic Information Portal) was sentenced to 5 years and 6 months in prison for the same crime. These three people are currently in detention.
It can be seen that Le Trung Khoa is an influential figure in the overseas Vietnamese community, and the lawsuit with Vingroup has brought his name into the focus of public opinion. No matter from any perspective, this is still an interesting legal case, clearly reflecting the intersection between media, business and international law.
