As a child, Kelly attended Tecumseh Elementary School, in DeWitt, New York, then at the age of 9 her family moved to Albany, New York, a suburb of Delmar. There, she attended Bethlehem Central High School. After graduating from high school, she attended Syracuse University and graduated with a bachelor's degree in political science in 1992; in 1995, she graduated with a Doctor of Legal Science from Albany Law School.
Kelly served as a collaborator in the Chicago office of Bickel & Brewer LLP Law Firm and wrote articles on lawsuits for the American Bar Association magazine. She then worked for Jones Day for 9 years until 2003 she moved to Washington, DC and worked as a reporter for ABC affiliate WJLA-TV. There, she wrote articles on important local and national events such as: the retirement of Justice Sandra Day O'Connor; the death of Chief Justice William Rehnquist; 2004 presidential election...
In 2004, she moved to Fox News Channel as a reporter, appearing on the weekly The O'Reilly Factor and On the Record focuses on legal and political issues. In February 2010, she became a presenter, commenting on programs including: America Live, Red Eye w/ Greg Gutfeld.
She was also the host of the 2010 New Year event and received the attention of a large audience during the 2012 presidential election.

In 2001, Kelly married anesthesiologist - Daniel Kendall, however, this marriage ended after 5 years of marriage. In 2008, she married Douglas Brunt - President and CEO of Authentium; They have three daughters together, Yardley Evans Brunt (2011), son Edward Yates Brunt (2009) and son Thatcher Bray Brunt (2013).
